“Bark Games,” “Adzap,” “we,” “us,” “our”: Bark Games, Inc., a Delaware corporation, doing business as Adzap.
“Services”: All advertising, marketing, analytics, attribution, and related services we provide.
“Client,” “you,” “your”: Any person or entity using our Services under these Terms.
“End Users”: Individuals interacting with your properties or campaigns through our Services.
“DPA”: The Data Processing Agreement signed between you and Bark Games.
1. Acceptance of Terms
By accessing or using Adzap’s Services, you confirm that you have read, understood, and agreed to these Terms of Use. If you do not agree, you must not use the Services.

3. User Obligations
3.1 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials.You must provide accurate and complete information when using our Services.You agree to notify us immediately of any unauthorized use of your account.
3.2 Acceptable Use
You agree NOT to:
Violate any applicable laws or regulations.
Infringe upon intellectual property rights.
Distribute malware or harmful code.
Engage in fraudulent activities.
Manipulate or artificially inflate metrics.
Reverse engineer, decompile, or attempt to extract source code from our Services.
Attempt to bypass or circumvent any technical protection measures.
Create derivative works based on our intellectual property.
4. Data Privacy and Security
4.1 Data Collection and Processing
We process personal data as a data processor under applicable data protection laws.Our obligations are set out in the DPA signed between you and Bark Games. You are responsible for obtaining all necessary consents from End Users.
4.2 Data Security
We implement commercially reasonable security measures to protect data.You are responsible for securing your access credentials.We are not liable for data breaches outside our reasonable control.
5. Intellectual Property
5.1 Ownership
All platform content, trademarks, and intellectual property belong to Bark Games, doing business as Adzap.You retain ownership of your content but grant us a license to use it solely to deliver Services.
5.2 Restrictions
You may not:
Copy, modify, distribute, or create derivative works from our intellectual property.
Reverse engineer, decompile, or extract source code.
Remove copyright or trademark notices.
6. Service Availability and Updates
We aim to provide continuous service but do not guarantee uninterrupted access.
We may modify, suspend, or discontinue Services with reasonable notice.
We may update these Terms; continued use constitutes acceptance of the changes.
7. Limitation of Liability
Services are provided “as is” and “as available” without warranties.
Bark Games’ total liability is capped at the greater of $10,000 or the total fees paid by you in the 12 months preceding the claim.
We exclude liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.
8. Termination
We may suspend or terminate access for material violations of these Terms.
You may terminate your account at any time.Termination does not relieve payment obligations accrued prior to termination.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
